Fact-Finding
The ability to conduct confidential internal fact-finding investigations is critical for companies faced with allegations of illegal discriminatory conduct, unethical workplace behavior or employee misconduct. The courts have taken the position that if companies provide their employees with an outlet for their complaints and take immediate corrective action as necessary, they can shield themselves from heightened liability.
Although many companies choose to conduct their own internal investigations, there is a strong case for bringing in a neutral third party fact-finder. An external party that is trained in the fact-finding process, has no loyalty to any of the people involved in the matter under investigation, and is not focused on setting up a defense for a future litigation, is most likely to provide the best possible result. There is also a trend for attorneys to refrain from conducting internal fact-finding investigations for their clients due to a concern that participation in such an investigation will result in a conflict of interest for them should the claim be pursued via litigation.
